Emergency Contact Authorization and Consent

When you designate an Emergency Contact in MyEcho, you authorize that person to care for your pet, enter your home where needed, and arrange veterinary care if you can't. The authorization comes from you, not from MyEcho. MyEcho is a technology and communication platform and is not an emergency service.
About this authorization
By designating an individual as an Emergency Contact through the MyEcho platform and accepting this authorization, you expressly acknowledge, represent, warrant, and agree as follows. This authorization forms part of the MyEcho Terms of Use and is recorded separately for each Emergency Contact you designate (shown in the app as a "trusted contact").
MyEcho is not an emergency, rescue, veterinary, pet-sitting or security service. It does not contact emergency services and does not guarantee that any notification will be delivered or that anyone will respond. If a person or animal is in danger, contact your local emergency services.
1. Designation of Emergency Contact
You acknowledge and agree that any Emergency Contact designated by you is selected solely and independently by you and is a person whom you know, trust, and voluntarily authorize to act in connection with the care and welfare of your pet.
My Echo LTD and My Echo Pets LLC, together with their respective affiliates, officers, directors, employees, contractors and representatives (collectively, "MyEcho"), do not select, appoint, recommend, screen, verify, employ, engage, supervise, control, or endorse any Emergency Contact.
You are solely responsible for determining the suitability, reliability, trustworthiness, availability, and authority of any person designated by you as an Emergency Contact.
An individual will act as your Emergency Contact only after receiving an invitation through MyEcho and accepting the designation and the Emergency Contact Terms.
2. Authorization to care for your pet
You expressly authorize your designated Emergency Contact, in circumstances where you are unavailable, unresponsive, unable to return to your pet, or otherwise unable to provide or arrange for your pet's care, to take such reasonable actions as the Emergency Contact considers necessary or appropriate for the immediate care, welfare, and safety of your pet.
Such authorization may include, without limitation, providing food and water, administering medication in accordance with information or instructions supplied by you, attending to your pet's ordinary care requirements, and taking reasonable measures intended to protect your pet's health and welfare.
3. Authorization to enter your home or property
To the extent reasonably necessary to access, retrieve, assist, or care for your pet, you expressly authorize your designated Emergency Contact to enter your residence, premises, or other property at which your pet is located.
Any such authority to enter your residence or property is granted solely and directly by you to your Emergency Contact and is not granted by MyEcho.
You are solely responsible for determining whether to provide an Emergency Contact with keys, access codes, security credentials, building permissions, entry instructions, or any other means of access to your property and for ensuring that any such arrangement complies with applicable law, including obtaining any permission needed from a landlord, building manager or other occupants.
If you add home-access information in MyEcho, it is shown only to the Emergency Contacts you allow to see it, and only during an active incident. You are responsible for changing codes or locks if you remove an Emergency Contact or no longer want them to have access.
MyEcho does not provide, authorize, control, supervise, monitor, or assume responsibility for an Emergency Contact's entry into, presence upon, or conduct within your residence or property.
To the fullest extent permitted by applicable law, MyEcho shall not be liable for any act or omission of an Emergency Contact in connection with such access, including, without limitation, theft, loss, misappropriation, unauthorized use of property, property damage, unauthorized access, personal injury, misconduct, negligence, or any other loss, damage, claim, cost, or expense arising from or relating to the Emergency Contact's entry into or presence upon your property.
4. Authorization regarding veterinary care
You expressly authorize your designated Emergency Contact, where reasonably considered necessary for the health, safety, or welfare of your pet, to transport or arrange for the transportation of your pet to a licensed veterinarian, veterinary clinic, veterinary hospital, emergency veterinary facility, or other appropriately licensed veterinary provider.
Where you cannot reasonably be contacted or are unable to provide instructions, you further authorize your Emergency Contact to communicate with veterinary professionals concerning your pet and, subject to applicable law and the requirements of the relevant veterinary provider, to request, arrange, or consent to veterinary examination, assessment, treatment, medication, hospitalization, diagnostic procedures, or other veterinary services reasonably considered necessary for your pet's health or welfare.
Any financial limits, treatment preferences, veterinary instructions, or other restrictions specified by you shall remain subject to applicable law and the policies and professional judgment of the applicable veterinary provider.
This authorization does not extend to a decision to end your pet's life unless you, or a person you have named for that purpose, have been reached directly and have agreed to it.
MyEcho does not provide veterinary services or veterinary advice, does not make medical or treatment decisions on behalf of you or your Emergency Contact, and does not represent or warrant that any veterinary provider will recognize or accept an Emergency Contact's authority to consent to treatment.
Unless expressly agreed otherwise in writing by MyEcho, MyEcho shall have no responsibility for veterinary fees, transportation costs, medication costs, treatment expenses, or any other charges incurred in connection with the care of your pet.
5. Role of MyEcho
You acknowledge and agree that MyEcho operates solely as a technology and communication platform intended to facilitate the transmission of information and notifications between users and Emergency Contacts designated by those users.
MyEcho is not, and shall not be deemed to be, the employer, principal, agent, partner, representative, supervisor, guarantor, pet sitter, caregiver, veterinarian, veterinary provider, emergency response service, security provider, or property manager of any Emergency Contact.
MyEcho does not assume custody, possession, supervision, or control of your pet or your property.
MyEcho will use commercially reasonable efforts to transmit notifications in accordance with your settings. However, delivery of notifications depends on mobile networks, devices, operating-system settings and third-party services outside MyEcho's control, and notifications may be delayed or may fail. You should not rely on MyEcho as your sole means of arranging care for your pet.
MyEcho does not guarantee that any notification will be delivered or that any Emergency Contact will respond to it, be available when required, access your pet, enter your property, comply with your instructions, obtain veterinary assistance, or otherwise take any particular action.
6. Acts and omissions of Emergency Contacts
You acknowledge that an Emergency Contact acts pursuant to your designation and authorization and not as an employee, contractor, representative, or agent of MyEcho.
Accordingly, to the fullest extent permitted by applicable law, MyEcho shall not be responsible or liable for any act, omission, negligence, misconduct, unauthorized conduct, error in judgment, failure to act, or other conduct of any Emergency Contact, including any resulting injury, illness, escape, loss, or death of a pet; theft, loss, or damage to property; personal injury; unauthorized access; veterinary expense; financial loss; or other direct or indirect loss, damage, liability, claim, cost, or expense.
Nothing contained herein shall exclude, restrict, or limit any liability to the extent that such liability cannot lawfully be excluded, restricted, or limited under applicable law.
7. User responsibilities
You are solely responsible for ensuring that all information supplied through MyEcho concerning your Emergency Contact, pet, veterinary provider, medication, medical requirements, care instructions, property access, and emergency arrangements is accurate, complete, and current.
You further represent that you have informed, or will inform, the individual designated as your Emergency Contact of such designation and have obtained any consent from that individual that may be required by applicable law, including their permission to give MyEcho their name, phone number and email address so that MyEcho can send them an invitation and, once they accept, notifications about your pet.
8. Information shared with your Emergency Contacts
Once an Emergency Contact has accepted, MyEcho shows them the information you choose:
- Basic: your pet's profile and photo.
- Care: also allergies, medications, needs, care notes, routines and instructions.
- Full: also the microchip number, where your pet is and where supplies are kept.
During an active incident, MyEcho may also show them the incident information you have set, such as your vet's details, your incident instructions, home-access information (section 3) and your location if you choose to share it, together with your name and contact details so they can reach you. 9. Changing or withdrawing an authorization
You can change an Emergency Contact's access level, edit or remove home-access information, or remove an Emergency Contact at any time in the app. An Emergency Contact can also withdraw at any time. A change applies from that moment; it does not undo anything already done or notifications already delivered. Deleting your account ends all authorizations.
10. Records we keep
For each Emergency Contact, MyEcho keeps a record of the version of this authorization that applied, the date and time you accepted it, the access level and authorizations you selected, the date and time the Emergency Contact accepted the invitation and the Emergency Contact Terms, and any later changes or withdrawal. We keep these records while the Emergency Contact is on your account and afterwards only as described in our Privacy Policy.
11. Express consent
By selecting the applicable checkbox or otherwise electronically accepting this authorization, you confirm that you have read, understood, and voluntarily accepted these terms and expressly authorize your designated Emergency Contact, subject to the terms set forth herein, to access your pet, enter your residence or property where reasonably necessary for such purpose, provide or arrange care for your pet, transport your pet, and seek or arrange veterinary care when you are unable to do so.
